[edit] Definition of Spyware and where MyWay products fallThe Wikipedia article on Spyware defines it as "Spyware programs can collect various types of personal information, such as Internet surfing habits and sites that have been visited" and this articles neutrality is not debated. MyWay end user license agreement, in section 7.2, states:
Source: MyWebSearch.com EULA, retrieved Sept 23 2009 So this section of the EULA for MyWay products specifically says that the toolbar and websites the toolbar is in contact with may provide access to search results to other websites or resources - in other words, without checking with the user, information collected from the toolbar or search terms that has been exchanged with the server can, by the terms of the EULA, be disclosed to third party sites without the explicitly given permission of the user. This, to me, matches the above definition of at the very least 'internet surfing habits' as given by the Wikipedia article on Spyware. Thus, I would conclude that MyWay software - no matter what they are calling it - that holds the language contained in section 7.2 of their current EULA, is by the definition agreed upon on Wikipedia, Spyware and thus malicious.
