The last paragraph seems to have originated with someone asserting that Birmingham University Guild of Students is wrong to claim the Act bars societies from having restricted membership. Reading it between the lines I don't think it's as clear cut so have rewritten it to include the relevant line. Does anyone know of any test cases on this? As far as i know (being lossly involved in some student politics up at Keele), no cases have gone to cort, but Exter (and others) have been having this "issue" Pickle 13:03, 1 March 2007 (UTC)

Would love to but don't know enough. Fundamentally it turns student unions into charity's and restricts what they can do in accordance with charity legislation (currently being reformed to turn them into something else, University of Birmingham Guild of Students#Government covers it well) - it thus stopped them from say supporting certain political view that weren't directly relevant to "student welfare". presumably it was due to help given to various strikers (eg miners) in the 1980s by some very militant unions. There are a lot of myths flying around about the 1994 Act and at times it seems to get attributed features that are actually in other acts or case precedents. Reading the Act much of it seems to be a series of requirements to ensure democracy, accountability and to give the mass of students the opportunity to veto affiliations if they wish. I can't see where it accords charitable status (and until recently most SUs have derived their charitible status from the parent institution, not from being a charity in their own right, although a few such a Cambridge are exceptions). The issues with ultra vires in students' unions predate the 1994 Act quite a way. Timrollpickering 21:56, 1 March 2007 (UTC)
