The legal representation of the Union, performed by the Solicitor-General's Office, also known as AGU (from Portuguese Advocacia-Geral da União), is defined by the 1988 Brazilian Constitution as one of the essential functions of the Brazilian judicial administration, alongside with the roles performed by the judicial branch, the prosecution service, the public defenders and private lawyers. All Solicitors of the Union must be bar members. The Solicitor-General takes part of the Brazilian cabinet with the rank of a Minister, and is nominated by the President of the Republic, after its indication is approved by the Senate. To be appointed, the Solicitor-General must be at least 35 years old. The Office of the Solicitor-General of the Union was created in 1993 with the main purpose of separating the activities performed by the federal prosecution service from the activities related to the legal representation and advising of the Union.
