Dato' Seri Dr. Mohamed Khir Bin Toyo (born August 6, 1965) was the former Dato' Menteri Besar (Chief Minister) of the state of Selangor in Malaysia. He lost the post of Menteri Besar Selangor after Barisan Nasional, the political party he contested under, failed to obtain majority in the Selangor state assembly during the 2008 elections despite himself winning with bigger majority in his Sungai Panjang constituency. [edit] FamilyOf half Indonesian and half Malay descent, Khir was born on August 6, 1965, at Tali Air 2, Bt 4, Sungai Burung, Tanjung Karang, Selangor, the fifth child of a total of nine siblings. His father, Joyo Erodikromo, was an immigrant from Java, Indonesia while his mother, Siti Aminah Mohd Taib, is of Malay ethnicity.[1][2][3] His wife is Datin Seri Zahrah Kechik who was born at Matang Road, Taiping, Perak. They have five children.[citation needed] [edit] CareerHe was a dentist by profession. He is also an active member of United Malays National Organization (UMNO), the main political party in the Barisan Nasional ruling coalition. He was also a member of UMNO's Supreme Council and Chairman of Selangor Barisan Nasional from 2000 to 2008. In 2004, Dr. Mohamad Khir won UMNO Supreme Council with the highest votes. Other positions that he holds in UMNO include the Chairman of the Selangor UMNO Communications Board and UMNO Division Head of Sungai Besar. He was the Menteri Besar of Selangor until the 12th General Election in March 2008. The state of Selangor fell to opposition hands following its worst defeat in Malaysian history. He was succeeded by Parti Keadilan Rakyat secretary-general, Abdul Khalid Ibrahim. However, he remains the state assemblyman of Sungai Panjang constituency and became Selangor opposition chief. On May 19, 2009, Khir Toyo was suspended for one year by the Selangor state assembly's rights and privileges committee due to his absence from the Selangor Select Committee on Competence, Accountability and Transparency (Selcat) inquiry into the alleged misconduct and inappropriate dealings of state charity Balkis.[4] [edit] Controversies & criticism[edit] Zero Illegal Squatters MissionIt was a mission set by Khir Toyo himself to make Selangor 'zero squatters'[5] in line with national policy Wawasan 2020. The opposition criticised Khir Toyo for approving housing project in squatters' area and forcing the residents to move out from their illegal homes. They claimed some of the village claim to be illegal homes had been built before independence in 1957 and most squatters living in a prime area are left homeless and received low compensation. The majority of the squatters are forced to rent or live in low-cost flats.[6] However report show most of the land is under private owner. "The (squatters) are occupying other people's land. The land will never be theirs as they are private land. They want the land but I can't give it to them" - Dr. Khir Toyo[7] Despite heavy criticism from opposition before this, the new Menteri Besar from opposition party, Tan Sri Abdul Khalid Ibrahim reported said the effort to reduce the number of squatters and to free them from the clutches of poverty, should continue.[8] In 2007, The state government had achieved 93.6 per cent success in addressing the squatter problem, having evicted 44,701 of the 47,756 squatter families to-date from all the local authority areas in the state. The remaining squatters to be moved by August are 1,090 families from the Selayang Municipal Council (MPS) and 257 families from the Klang Municipal Council (MPK), the media secretariat in the Menteri Besar's Office said in a statement. A total of 1,708 squatter families were shifted following court cases, resettled to the North Gombak Orang Asli settlement and planned villages, it said. However, four local authorities still had squatters. They are MPS (984), MPK (221), Shah Alam City Council (307) and Ampang Jaya Municipal Council (196).[9] [edit] Palatial Mansion / Khir Toyo's PalaceDAP's Ng Suee Lim on July 6, 2009 revealed documents which allegedly confirms allegations which first surfaced over the Internet months ago that Dr Khir owns the mansion on Jalan Suasa 7/1L in Shah Alam, that costs upwards of more than RM23 million. [10] He said the resort-like home of the former Menteri Besar had been built on two plots of land measuring over 50,000 sq ft or 1.17acres, dwarfing the infamous Istana Zakaria built by the late Port Klang assemblyman Datuk Zakaria Md Deros.[11] In his rebuttal, Khir Toyo said he took a RM3.5 million loan to buy a sprawling Balinese-style mansion in an exclusive neighbourhood, brushing off allegations that the property is valued at RM24 million.[12] He has threatened to sue Sekinchan Assemblyman Ng Swee Lim for making the claim, pointing out that HSBC would not have approved the loan if it was not above board and also countered claims that he could not afford to purchase the house on what he was being paid as mentri besar at the time.[13] Ng continued focusing his attacks on Khir’s finances, and argued that it was also not possible for the Khir to afford the RM3.5 million loan he claimed to have taken from HSBC to buy the mansion. He alleged that Dr Mohd Khir would have to pay RM16,000 a month to service the loan, while his allowance as opposition leader was just over RM8,000 a month.[14] Khir explained that he was able to pay the housing loans as his side income as a dentist was high because he not only specialised in dentistry but also specialised in cosmetic dentistry and that the cost of a dental implant was anything between RM40,000 to RM50,000.[15] This was however disputed by PR assemblyman and state executive council member Dr Xavier Jeyakumar who said there was no way Dr Mohd Khir could have been practising dentistry legally while still the Menteri Besar. He had made checks with the Malaysian Dental Association showing that Khir did not have a licence to practise during the eight years while he was mentri besar and only just renewed his licence.[16] When Dr. Khir was a Menteri Besar he earn about RM48,000 per month. Before he was a Menteri Besar he earned about RM60,000 a month as a dentist. After 2007, he own a few business which include a dentistry clinic and a pharmacy.[12] [edit] Luxurious Exco VillageThe Selangor State Government had spent an estimated RM40 million to built an "EXCO VILLAGE" which comprises 10 bungalows and a clubhouse in Section 7, Shah Alam exclusively for the use of Selangor executive councillors.[17] State Opposition member questioned the rationale for the estimated RM40mil project of public funds as the State government already gives it members a housing allowance.[18] [edit] Housing Projects on Reserve LandMany of the land which belonging to state government has been sold for housing projects during Khir Toyo administration. Some of the land was supposed to be reserved land for forest or a public park. It has been revealed that some 4,326ha of the 241,568ha of forest reserve in Selangor had its status cancelled between 2000 and 2007 mostly to develop real estate projects.[19] Among the land which been sold to developer is the Batu Tiga Speedway Circuit in Shah Alam, which is the first circuit in Malaysia opened in 1968. The land is between Shah Alam Stadium and Lebuhraya Persekutuan now are a housing area name D'Kayangan. Housing Project Achievement: Selangor Builds On Its Housing Success, A Model For Other Nations [edit] Bukit Cahaya ReserveKhir Toyo had been accused of corruption for approving a construction project which trespasses Bukit Cahaya Seri Alam in Shah Alam, a forest reserve.[6] To prove his innocence, Toyo had asked Anti-Corruption Agency of Malaysia to investigate the incident.[7]. In 2004, Anti-Corruption Agency declared no case against Khir Toyo. [edit] Selangor State Development CorporationThe current Selangor state government claims that lopsided agreements in joint venture real estate projects under the previous Khir Toyo and BN state governments led to losses of about RM30bil in revenue over the last 30 years. It was discovered that the Canal City joint-venture project awarded by the Khir Toyo state government about 810ha of free land to a private company with estimated returns of only RM22mil for the state over a period of more than five years.[20] On October 30, the current State government of Selangor began investigations into irregularities by the Selangor State Development Corporation when it was run by Khir Toyo. A special investigative team which was set up for the purpose would probe how certain senior officers of the corporation were holding 30% shares in a subsidiary. This included an investigation of RM100,000 gift to former Mentri Besar as a bonus. In 2007, the state government only collected RM17mil revenue from sand mining instead of the RM170mil which it was supposed to get. [21][22] However until now, new state government found nothing in their investigation. The new state government claimed they can collect around RM 200 million per year. But in recent Selangor State Asssembly, State Government declared, for the last six month, they collected only RM 1.475 million in sand mining.[23] [edit] Zakaria Mat Deros illegal mansionZakaria Mat Deros, the Klang assemblyman (UMNO) in Selangor built his illegal mansion without any proper construction permit from the local government. He built the illegal mansion in an urban poor district in Klang which is supposed to be used for low-cost housing. Under the Selangor law, his illegal mansion should be seized and Zakaria should be prosecuted. However, Toyo has been criticised for forgiving Zakaria's mistake and did not take any action against Zakaria.[8] Zakaria died of a heart attack in his home on 11 March 2008 at about 1.30 am Malaysia time.[24] [edit] Balkis Accounts ScandalAfter the March 8 Malaysian General Elections, Wives of Selangor Assemblymen and MPs Welfare and Charity Organisation (Balkis) transferred out the RM9.9mil from its coffers a few days after the state fell to the Opposition. Khir Toyo said the money was “temporarily transferred” to the Association of Wives of Ministers and Deputy Ministers (Bakti). Defending the money transfer, then president Datin Seri Zahrah Kechik said she had the legal right because her husband Datuk Seri Dr Mohd Khir Toyo was still the caretaker Selangor Mentri Besar at that time. The state government, however, is questioning the transfer of the money and seeking legal advice. It has also asked the Registrar of Societies to put on hold the dissolution of Balkis.[25] Auditors for the Wives of Selangor Assemblymen and MPs Welfare and Charity Organisation (Balkis) yesterday said the charity's accounts for 2007 were never audited or finalised, contrary to claims by Datuk Seri Dr Mohd Khir Toyo. [26] On March 11, 2009 Bukit Antarabangsa state assemblyman Azmin Ali accused the wife of former mentri besar Datuk Seri Khir Toyo of misusing state funds for overseas holidays, including a 2007 trip to Tokyo Disneyland. He stated that government records showed that Datin Seri Zahrah Kechik also misused welfare allocations to buy clothing and accessories. These included so called technical visits to Korea and Hong Kong.[27] The representatives of all three state subsidiaries - Selangor Agriculture Development Corporation (PKPS) deputy general manager Mohamad Nordin Darhan, former Selangor State Development Corporation (PKNS) chairman Datuk Harun Salim and Kumpulan Darul Ehsan Berhad (KDEB) president Datuk Abdul Karim Munisar testified that they paid the bills forwarded to them by Balkis. [edit] Kumpulan Darul Ehsan BerhadKDEB forked out almost RM700,000 to sponsor Balkis functions from 2002 to 2005. This included RM17,000 for flight tickets for seven to Guangzhou where the Balkis entourage headed by Zaharah spent RM206,574.89, also paid by KDEB, to buy souvenirs such as multi-coloured flowers and 2,700 pieces of caps at RM8 each.[28] KDEB also paid RM100,000 for dinner organised by Balkis at the Sunway Lagoon Resort and Spa Hotel on July 24, 2007, a week before the association co-hosted three dinners costing RM450,000.[29] [edit] Permodalan Negri Selangor BerhadOn March 24, 2009 Selangor Select Committee for Competency, Accountability and Transparency found out from the chief executive officer of Permodalan Negri Selangor Berhad (PNSB) Datin Khairiyah Abu Hassan that Balkis was given the amount of RM500,000 to RM1.6 million annually in the name of Corporate Social Responsibility.[30] More than RM338,000 was paid by PNSB for a Bakti sporting event hosted by Balkis, which included sportswear worth RM131,000 for 400 people and 180 liaison officers.[31] It was discovered that over RM14,000 was spent by PNSB to purchase return business class and economy class tickets sometime in December 2007 for Khir Toyo's wife Datin Zahrah Kechik to visit their son in Melbourne.[32] [edit] Pig Rearing ProjectDuring Khir Toyo as Menteri Besar of Selangor, he and his cabinet had make a study to built pig-rearing center in Selangor. This pig-rearing center would be a high-tech integrated pig-rearing project with cleaner technique to reduce pollution which arise from the older technique of pig-rearing. The new Menteri Besar Tan Sri Abdul Khalid Ibrahim, announced that the RM100million integrated pig-rearing project, which was approved by the former Barisan state government led by Datuk Seri Dr Khir Toyo, would proceed. Khir Toyo denied it and said he was never approved the pig-rearing project. This lead Khalid show the picture of some Toyo's cabinet visiting a pig-rearing center in Germany to the media.[33] Khalid's administration has not disclosed any EXCO document to verify their contention. [edit] Accuse of spreading lies about a petition to ban mosques from airing AzanKhir Toyo make an accusation that a Pakatan Rakyat component party was trying to ban mosques from broadcasting the azan (Muslim call to prayer) on loudspeakers. On September 11, Kota Raja Member of Parliament MP Dr Siti Mariah Mahmood has lodged a police report against Khir Toyo in Dang Wangi Police Station.[34] She lodged the police report against former Selangor Menteri Besar Datuk Seri Dr Mohd Khir Toyo together with the website pembelamelayu.com for spreading malicious slander and lies about certain quarters pressuring the state authorities to tone down the call to prayer at mosque and surau in the state.[35] On September 12, 2008 DAP's Seputeh MP Teresa Kok was arrested under ISA. Khir Toyo allegedly accused Kok of being involved in connection with a residents petition in Puchong over a mosque.[36] The current Selangor state assembly condemned Khir Toyo for stoking racial discord and for inciting hatred against Kinrara assemblyman Teresa Kok.[37][38] [edit] Investments in Saudi ArabiaAccording to audits done by the current Selangor state government, the Barisan Nasional state government under Khir Toyo made unauthorised investments for properties in Mecca, Saudi Arabia worth RM17.5 million in 2007. The acquisitions were made through the state investment agency Permodalan Negeri Selangor Berhad (PNSB) without the approval of the board of directors.[39] [edit] Failure to declare benefits and perks to the Inland Revenue BoardThe scandal-riddled Permodalan Negeri Selangor Berhad (PNSB)was discovered by auditors that they never declared non-monetary benefits to the IRB, including those given to Khir Toyo. Among the benefits are cars and drivers as well as holidays to local and international destinations. In 2005, Dr Mohd Khir was provided a Toyota Harrier, while a driver was provided a year later and he had used these benefits until he resigned as PNSB chairman in March 2008.[40] [edit] Accusations of involvement in the opposition DAP political aide's deathThe mystery letter delivered on the August 18, 2009 to Gobind Singh Deo, the lawyer for Teoh Beng Hock’s family, was sent by anonymous parties claiming to be MACC officers who urged the authorities to probe a senior anti-graft officer for corruption and together with the involvement of a politician in the DAP political aide’s death.[41] Khir Toyo has denied allegations contained in a mystery letter purportedly written by unnamed MACC officers that implicates him in a conspiracy with a senior anti-graft officer to bring down the Pakatan Rakyat Selangor government, which was the cause of Teoh Beng Hock's death.[42] [edit] References
