The 1987 Supreme Court case California v. Cabazon band of Mission Indians, 480 U.S. 202 (1987) 480 U.S. 202, determined that if a form of gaming is illegal in a state, Indian reservations may not engage in that form of gaming, and if a form of gaming is legal in a state, Indian reservations may engage in that form of gaming, regardless of other laws limiting the gaming. [edit] DetailsThe Cabazon and Morongo bands of Mission Indians occupy reservations in Riverside County, California. Each band holds bingo games on the reservation. The Cabazon band also operated a card club for poker and other card games. The gambling games were open to the public and generally played by non-Indians. California and Riverside County sought to apply its laws concerning regulating bingo and prohibiting poker games to the tribes reservations. The tribe instituted an action for relief in Federal District Court which held that neither the State nor the county had any authority to enforce its gambling laws within the reservations.
